Freedom of Speech vs. Censorship Essay

Adopted in 1791, the First Amendment, states â€Å"Congress shall make no law abridging the freedom of speech, or of the press or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.† (Pilon) The freedom of speech documented in the First Amendment is not only a constitutional protection but also an inevitable part of democratic government and independence, which are essential values in society. â€Å"Censorship,† according to Justice Oliver Wendell Holmes, â€Å"is an almost irresistible impulse when you know you are right† (Sunstein). That is why the American citizen’s right to free speech should be held as the highest virtue and any censorship of freedom of speech should not be allowed, however, should be respected. Freedom of speech is essential part of democratic government because the only way truth can emerge when there is an open competition of ideas. However, there is a strong support of censors hip when people start mentioning extremely offensive opinions. Should the freedom of speech be limited in this case? The answer is â€Å"No†. â€Å"If liberty means anything at all,† writes George Orwell, â€Å"it means the right to tell people what they do not want to hear.† (Cox) If we want to enjoy the freedom fully, the full protection should be given to the freedom of speech; there are no compromises about it. Freedom of speech protected by the First Amendment is not just a right, which can be declared or abolished. According to the â€Å"liberty theory,† proposed by some legal scholars, freedom of speech is an essential part of the liberty of every person who pursues an individual self-determination and self-realization (Cox). Thus, freedom of speech is also a global right one that permits freedom of personal development and self-expression. Another theoretical ground to support the freedom of speech is called â€Å"tolerance theory.† It holds that the ability to teach and promote tolerance is one of the most important assets of freedom of speech (Cox). From this perspective, freedom of speech itself excludes any type of intolerance, which sometimes appears in a threatening form (religious intolerance, racial intolerance). The â€Å"tolerance theory† implies self-restraint, which is the only appropriate response to any ideas, even those that we may personally may dislike or hate. The â€Å"tolerance theory† provides a broader context for exercising tolerance in a conflict-ridden democratic society. Furthermore, in legal practice there are certain restrictions on freedom of speech imposed by the Supreme Court. They define a few categories of speech, which are considered not to be fully protected by the First Amendment. These categories include defamation, advocacy of imminent illegal conduct, obscenity and, fraudulent misrepresentation (Farber). However, if the speech does not fall within one of these categories, there are no grounds for the government to argue that freedom of speech should be restricted because of its harmful content. One of the common bases for partial censorship is proof that the freedom of speech causes imminent illegal action. The Supreme Court has already drawn a careful line between general abstract theories and political dissent on one hand and particular illegal acts incitement on the other. This line is drawn by definition of â€Å"clear and present danger† test (Farber). The government cannot sue the speaker on the basis of its tendency or possibly illegal conduct incitement. Before any speech is punished on the grounds of incitement, there is an obligatory three-part criterion that should be met. First, the speech must directly incite lawless action. Second, the context of speech must imply imminent breaking of the law, rather than call for illegal conduct at some indefinite future time. At last, there should be a strong intention to produce such conduct (Farber). Such â€Å"clear and present danger† test determines the level of probability of threat imposed by the speech in question. However, the evil, which the government tries to prevent by outlawing the advocacy, does not outweigh the harm of outlawing the free speech. Only when the imposed danger becomes evident, the freedom of speech may be questioned. We must be aware that the price for preventing several cases of the openly declared illegal conduct may be paid by restriction of one of the most essential rights that constitute freedom for the entire nation. For the wellbeing and public safety, the Supreme Court has imposed certain regulations on the freedom of speech not because of its content, but because of the time, place and, manner the speech is being expressed (Farber). The court pointed out in Snyder v. Phelps (2011) that one way to ascertain whether a restriction is content-based versus content-neutral is to consider if the speaker had deliver a different message under exactly the same circumstances (Supreme Court of the United States). However, these rules do not limit the actual freedom of speech and are not even upheld, if there is no public need for this. However, concerning the content-neutral regulation, it raises many controversial issues. The content-neutral regulation requires a very careful distinction and therefore may sometimes be misinterpreted. There is a raising concern that such regulation may weaken people’s right to participate, especially if the government puts too many restrictions on how the ideas should be voiced. Thus, by analyzing the current issues concerning the First Amendment right to free speech in the United States, I wanted to show the perspective of outlawing this right, and the negative aspects t hat such outlawing may involve. Freedom of speech has served a crucial role for the right to dissent and for the entire principle of democracy in our society. This law was developed during the course of American history and only after numerous struggles it was achieved. The evolution of this law is still in progress however, the limitation of the basic right to free speech may as well limit our freedom and democracy, therefore should be respected and protected. How have critical thinking skills in humans evolved over time? – Since evolution is a process which takes millions of years, The human fossil record reveals that our ancestors were capable of using stones as tools. An ape-like human ancestor living a million years ago was custom manufacturing a variety of stone tools and using fire. Early humans used even more sophisticated tools such as spears and arrows. These â€Å"stone age† people are depicted as â€Å"cavemen† but this belies the fact their culture was fairly sophisticated. The proof is the last stone age culture encountered in modern times – Native American â€Å"Indians†. Many meso-american cities were far larger than european cities during the middle ages. Looking at modern euro-american culture, it is seen the only real difference is technology based on metal instead of stone. All the social institutions are still present, reguardless of the particular style of political system behavior in use. Humans probably have not evolved mentally since they evolved as a separate species. In a sence, it is our technology which is evolving. How have the principles of logic helped shape modern science and technology? – Logical thinking provided a method by which scientific thought could evolve. The general assumption allowed a statement – the presence of (whatever) is always accompanied by (Something else). (Whatever) is present, therefore (Something else) is also present. The ability to move from the solid ground of a known fact to assuming the possibility of another fact allowed a test for the second fact, and allowed thought to outpace knowledge, so that people thought impossible things and found ways to obtain them. How does a critical analysis of one’s society and self contribute to a particular internal and/or external perspective on the world? Critical analysis of self and society of course involves challenging one’s current view of oneself and one’s current view of one’s society (not to mention a society’s view of itself). In order to do this, one must take up a stance that falls outside of one’s habituated perspective. To the extent to which â€Å"perspective† differs from â€Å"horizon†, I’m tempted to say that the horizon would be a circle that surrounds and contains various perspectival circles, such that a horizon is richer than any given perspective but it’s still distinct from other horizons. These other horizons may be represented by circles which either overlap the first but are not synonymous (like the Olympics symbol), or which stand entirely outside each other as â€Å"O O†. Each self could contain within it’s horizon perspectives, and each â€Å"self-horizon† could be a perspective within a social horizon. In other words, each person has the potential of taking up plural perspectives within his/her horizon, and likewise a culture as a whole can take up different perspectives within its horizon.

Lord of the Flies Play Essay

Lord of the Flies is a play about a group of evacuees who have had a plane crash. All the adults are dead and the group of boys are now left to survive by themselves on a desert island, that at first seems like paradise. They become split into two different groups. One group has Ralph as their leader and they try to stay civilised and normal, but the other group lead by Jack act like savages and at first they only kill a wild pig that is already on the island. The social influence of class divide on the island was shown well by the Pilot theatre company. It was clear to the audience who had a higher status on the island. They used their spoken language as one of the main differences. For example Piggy was from a lower class background and was therefore inferior to the rest of them. He spoke using very common language and the other boys teased him because of it. He was very much an outcast on the island and his clothes were like rags compared to the Public school boy’s posh outfits. Piggy was never part of the group; he always stood slightly on the outside of the circle. One of the cultural influences on the play was a child’s capacity to murder intentionally. This came out through Jack and his followers. The theatre company showed that like the James Bulgier killers they thought about who and why they were going to kill. Their reasons weren’t good reasons but they were enough for them to decide it had to be done. They used their physical strength and power over others like bully’s do. They decided the way to go and if you didn’t fit in then you would be discarded of. It was rather like the war that was going on in the outside world at the time where if you were a Jew you had to be destroyed. The way Jack lead his gang was from a very Fascist viewpoint. At the beginning they used Democracy to decide who was going to be leader and Ralph was the one who was voted for. Jack was very angry with this, as he wanted to be in control. He wanted total power over the rest of the group and he didn’t like the way Ralph tried to organise everyone. In the play the characters built a fire at the top of a hill on the island. The theatre company used a small real fire on the stage and a small red spot light to give the audience the idea of the fire. When the fire spreads out of control they mostly just use themselves and their acting to show the fire. I thought this was very effective because with the real fire on stage the audience could visualise what it would have looked like. I thought that the fire came to represent hope and survival because it was their only way of signalling to passers by where they were. They used Piggy’s glasses to make the fire and they were the only way they could make a fire so these also represented the boy’s survival. Whoever held the glasses was the most powerful person on the island because of what they symbolised and they were taken from Ralph’s gang by Jack. This showed that he was more powerful and fitter than the others. The theatre company also used levels to show his status. They put his camp higher up on the stage, which demonstrates his domination and superiority. He also had the pig’s head from the pig that he killed on a pole at the entrance to his camp to show off his power but also his bloodthirsty madness. At the beginning the lighting was a bright blue in the background and a bright white in the foreground. The lighting scheme darkened throughout the play as the atmosphere became tenser. It was a shock and a strong dramatic anti-climax at the end when the extremely bright white helicopter lights came down. This symbolised the rescue and the return from darkness. White is a very clean colour which contrasted with the dirty greens and reds used for most of the play. It illustrated to the audience the change from a murderous gloom to normality. It is the realisation of what has happened to them on this island. On the first night that they stay on the island the dark red light in Ralph’s camp signifies the fire and all that is attached to that. They cross-faded the darkness to show the divide between the two gangs. There was a back projection behind the action that reflected the action that was taking place on the stage. They used the lighting to illustrate the storm and their fear by creating a lightning effect in the background. Techno music was used in this play to demonstrate the savage, frantic, mad agitated and ritualistic atmosphere on the island. The most noticeable time that it was used was at the beginning of the play during the plane crash. It created tension, anticipation and a climax at the very beginning to get the audience interested right from the start. They also used choir music as a symbol of who they were, their class and their innocence at the beginning. It contrasted greatly with the more sinister sounds in the second half of the play. There were lots of natural sounds used to show that they were out on their own with nature. The audience could always hear always lots of flies making them think about the title of the play. At the end of the play there was calming chill out music to signify the end of the trauma. They used a female voice because it sounds softer, more angelic and soothing. The whole group started the play off with this frantic, repetitive dance. This symbolised the plane crash. There was always a quick pace during the hunts and their movements were slightly jumpy and alert like they were about to pounce on something. It showed the tension, excitement and nerves they felt while they were out to get something. Jack is quite posh so he uses more sophisticated language compared to Piggy. He also wears a hat to show that he is the leader of the choir. This is another thing that sets him higher than the other characters. In the beginning their voices were quite light and jokey. It was like they weren’t taking their situation seriously, but as the play progressed Jack’s voice became sterner, stronger and slightly hysterical. Ralph’s was determined but got weaker and more helpless. Piggy’s was always whiney and attention seeking. I thought that these were good characterisations and I probably would have done it the same, although I might have made Jack slightly meaner than he was. The choir seems very innocent at the start and they are very proud of their uniforms. They are all wearing similar quite formal things to represent their respect for their heritage and their social status. Ralph’s costume is relaxed and laid-back compared to the rests he seems more genuine and open than the Public school boys. Piggy wears scruffy old clothes. Roger was the most savage of them at the start and he also had the least costume. Their clothes are a symbol of civilisation and culture and they try to use them to get back to reality. They clung on to uniforms for security and structure. The costumes are a strong symbol of class and divide. Jack’s gang cover themselves in war paint, feathers and blood showing their savagery. It also represents their strength power and ruthlessness. The more they lost their clothes, the more they lost sight of civilisation. This is the symbol of them turning to the wild. Jack’s gang lost the most clothes and they also becam e the most savage. This play is very much about the survival of the fittest, which is why Jack came out the best because he was willing to do anything he thought he needed to do in order to survive. The play also shows the audience that we are all savages on the inside and that we need society and rules to guide us the direction of civilisation. At the start of the performance Ralph takes up lots of space to show his confidence, but he gradually became more slumped as the play progressed, until he was a crying ball on the floor unable to speak for himself. Jack stood tall throughout the play, which shows us that he beat Ralph both mentally and physically like a bully. Jack takes Ralph’s space away from him to show his strength and fearlessness. The set design was multifunctional. The plane parts were easily moved by the actors unnoticeably during the play and could be to the audience whatever the actors imagined it to be. The wing came to represent death because it was where they killed Simon and it was tipped to create the cliff where they killed Piggy. The wing was also metallic which showed the reflected sun and the heat. They could also use the set to make noises like during the hunts. They banged it to create atmosphere and tension and they ran through it like it was the maze of the jungle. They could change the angles of the set to show the different parts of the island. Ralph’s camp was under the plane, which makes the audience think that they are hiding from Jack. The way the ripped up plane is always on the stage both ruins paradise and is a constant reminder of why they are there. It is also a symbol of the ugliness of what they have done and it shows the divide between the two groups. The plastic backdrop glittered and rippled to show the sea. I thought the way the set was produced by the theatre company was both effective from the audiences point of view and the actors. This is because of the way it could be changed easily and it made the audience fell like they were there too. The divide between the two gangs represented civilisation v savagery. Ralph’s gang representing civilisation and Jack’s gang representing savagery. They both choose their different paths and out there with no one to take charge brute force won over the democratic ways of civilisation. Overall I thought that the Pilot theatre company’s use of Drama Mediums and the Elements of Drama were very effective in communicating the themes and the social, cultural and historical influences on the play. Not only did they use these very well but I also found the performance enjoyable and interesting.

Live by the foma (harmless untruths) that make you brave and kind and healthy and happy

Foma, are an everyday part of life. No one knows if there truly was a person who created the earth and all its inhabitants, or if one person can start a whole new way of life with just one idea. One must live by certain foma, but at the same time a person must know which ones not to live by. America itself is one giant foma. There are untruths about religion, family life, war, and society in general spread all across America today. Religions are foma in themselves, for it is not certain what a religion is based on, or if the stories of that religion are even true. People, not just in America, but all around the world believe in something that has not been proved. The family lives in America are also foma. There has not been an American family found in any historical account, in which the children were perfect. Humans are, and will never be perfect. The next major crisis in America is war. Terrorists are trying to attack the country, and they expect to do so just because the country is distracted by a few anti-war protests. No matter how hard people try to argue against war, it always happens, just like no matter how hard soldiers train, they will never be fully prepared for war. Lastly, society is one large foma. Social classes seem to be taking over America. The more money a person has, the more money that person will get. However, if another person has very little money, then his or her amounts of money will just keep decreasing. The way a person walks, talks and acts all contribute to the social status of that person, therefore determining his or her own destiny. Everyone lives by at least one foma, and family life is the most important one. Families all over the world have struggled to be the â€Å"perfect† family seen on television. But no matter how hard they try, it won't happen. The trouble with the world being all lies, is that it is hard to find a truth to live by. However, there is one: all religions are lies. People do not go to church to make themselves better in the eyes of the Lord, God, etc. Today, prayer is used for the greed of society and not for how it was originally used, to cleanse society. Religion is not worth anything to a person who sees and understands how much of religion is a foma- all of it. No one can tell you what is a truth and what is a foma. People must decide for themselves, or their whole lives will turn into lies. There is a world full of lies, all because people do what others want them to do, just so they can fit into society. A society full of lies is not a society at all, but merely one large foma.

Michel Eyquem de Montaigne was born on February 28, 1533, into a time when only the wealthy received the privilege of a good education. At around 1539, Michel was sent to the College of Guienne in Bordeaux, where he completed the curriculum under the direction of George Buchanan by the time he had reached his thirteenth year.
